Danaye L. Shiplett (the Artist) owns and operates young@art (Site).
Please read these Terms and Conditions (Terms) carefully before using this Site. Your access to and use of the Site and any content within is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use this Site.
By accessing or using this Site you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access this Site.
2. Copyrights
2.1 Intellectual property rights
Unless otherwise stated, the Artist owns the intellectual property rights to the Site and all content within.
You may view, download (for caching purposes only, unless otherwise designated), and print pages or other content from the Site for you own personal use, subject to the restrictions set out below and elsewhere in these Terms.
You must not:
(a) republish material from this Site or any social media pages controlled by the Artist (including republication on another website) without the Artist’s explicit written consent;
(b) sell, rent, or sub-license material from this Site or any social media pages controlled by the Artist;
(c) show any material from this Site or any social media pages controlled by the Artist in public without: (1) crediting the Artist and (2) linking back to this Site or the social media page controlled by the Artist where the material is posted;
(d) reproduce, duplicate, copy, or otherwise exploit material on the Site or any social media pages controlled by the Artist for a commercial purpose;
(e) edit or otherwise modify any material on this Site; or
(f) redistribute material from this Site except for content specifically and expressly made available for redistribution by the Artist.
2.2 Creative Commons license
When the Creative Commons license is explicitly written on Content within this Site (either at the end of a post or embedded in a graphic or illustration), the Artist grants you access under the Creative Common license to share and adapt only that item given express consent.

3. Use of this website
3.1 Acceptable use
This Site shares information, text, graphics, videos, or other material by or about the Artist (Content) . You must not use this Site or Content in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site; or in any way which is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
You must not use this Site to copy, store, host, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious computer software.
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction, and data harvesting) or in relation to this Site without the Artist’s express written consent.
You must not use this Site to transmit or send unsolicited commercial communications.
You must not use this Site for any purposes related to marketing without the Artist’s express written consent.
3.2 Posts and comments
When posting on this Site:
(a) you agree that you will not post material that contains content which is harmful, threatening, abusive, vulgar, obscene, harassing, defamatory, offensive (racially, sexually, ethnically, or religiously), promotes a political view, or is otherwise objectionable;
(b) you will not post or transmit chain letters, pyramid or money schemes;
(c) you will not use your email account to: (1) impersonate any person; and/or (2) “spam” by posting frequent/and or annoying messages;
(e) material that you post must not contain links to site that open up multiple windows or to sites that contain material that would fall within clause 3.2 (a) above;
(f) you agree that you will not post content, the display of which would infringe the intellectual property rights of any third party. In particular, you represent and warrant that the content of your posting is original and not copied from any third party;
(g) you agree that you will not use the comments section to offer items or services for sale or place advertisements for goods, products, or services of third parties;
(h) if you breach any of the provisions set out in this clause, the Artist may contact you with a warning to cease and desist. Continued breaches of any of the provisions set out in this clause will result in the Artist immediately blocking your ability to post comments on any current or future pages or posts (see section 3.5 for more information);
(i) the Artist reserves the right not to publish any material that you post in its absolute discretion; and
(j) you consent to the Artist moderating your posting prior to distribution.
3.3 Data privacy
This Site does not sell or give out your personal information, email address, or any other information to third parties.
The Site does not knowingly collect or solicit personal information from persons under the age of thirteen (13). If you are under 13, please do not send any information about yourself to the Artist, including your name, address, telephone number, or email address. No one under the age of 13 may provide any personal information to or on the Site. If you are under 13 and would like to contact the Artist, please do so through a parent or legal guardian.

3.4 Links to other web sites
You are responsible for all of your activity in connection with the Content and accessing this Site. The Site may contain links to third-party web sites or services that are not owned or controlled by the Artist.
3.5 Liability
The Artist has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Artist shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.
4. Goods and services
When you commission the Artist for an illustration, design, or other work, you enter into a Letter of Agreement (LOA) that is drawn up and signed by both parties at the time of commission. The terms and conditions outlined the LOA are subject to change at any time by the Artist (see section 5.3 of these Terms).
5. Disclaimers
5.1 Accuracy
The Artist attempts to ensure that the contents and information provided on this Site is accurate at the time of posting. Unfortunately, she cannot guarantee the accuracy of contents or information contained within the Site and any person using information contained within the Site does so entirely at their own risk.
5.2 Virus protection
Although care is taken to check and test material at all stages of production, the Artist cannot accept any responsibility for any loss, disruption, or damage to your date or your computer system which may occur whilst using material derived from this Site.
5.3 Changes
The Artist reserves the right, at her sole discretion, to modify or replace these Terms at any time. If a revision is material she will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at her sole discretion.
